Lateral movement remains a dynamic part of the legal market, especially in Arizona’s ever-evolving landscape. However, compensation packages for lateral partners aren’t as straightforward as one may think. While headlines often focus on big guarantees or flashy bonuses, the realities are far more nuanced. Compensation is never just about the number on the offer sheet; it’s about whether a firm’s structure aligns with a partner’s business, career goals, and long-term success.
Beyond base pay or initial draws, partners should take a deeper look at the full compensation system before making a move. Here are key considerations:
Origination Credit Structures: How does the firm allocate credit for bringing in new business? Does the firm allow you to retain full credit for business you originate or is credit shared among team members—and how is that handled if you eventually move on? A clear, fair policy on origination can significantly impact long-term earnings and internal collaboration.
Collections Expectations: Some firms prioritize billed hours; others care more about collected fees. Partners should understand how collections targets are set, enforced, and whether uncollected receivables affect their compensation.
Team Support and Client Transferability: Partners need to assess whether the firm’s infrastructure—billing, staffing, marketing—supports client retention and growth. Will clients easily transition, or face friction with conflicts, rates, or team integration?
Sustainability of Bonuses and Guarantees: A short-term incentive may be appealing, but long-term compensation tied to performance, and the firm’s health, should be the real focus.
Equity vs. Non-Equity Transparency: If you are not going in as an equity partner, does the firm offer a clear path to equity? Are the expectations for buy-in, capital contribution, and voting rights transparent? Understanding the distinction between equity and non-equity roles helps lateral partners avoid surprises down the road.
